Directives Issued as Kenya Rugby Union Elections is Declared Null & Void

The Kenya Rugby Union (KRU) was ordered to conduct fresh elections after the Sports Dispute Tribunal (SDT) declared the elections held on September 6, 2022, as null and void.

The tribunal annulled the election stating that KRU failed to meet certain thresholds and that the exercise was marred with irregularities.

In a ruling delivered on February 14, 2023, SDT ordered fresh elections within 60 days.

“The Tribunal in finality ordered as follows; a declaration that the KRU Elections of September 6, 2022, are annulled, KRU ordered to hold elections within 60 days, that the fourth, fifth and sixth officers are illegally in office, that the elections are to be conducted by an independent panel consisting two members (female and male ) appointed by the board, one representative from Kenya Cup, one representative from Champion side, one representative from women rugby and the CEO of KRU to be a secretary (who shall have no voting rights),” part of the ruling read.

It was also highlighted that the KRU Constitution is inconsistent with the Constitution of Kenya 2010, The Sports Act, and the Registrar’s Regulations.

Among the irregularities cited by the SDT included falling short of the 30 days notice period, lack of an independent election panel, interference by the Sports Registrar and ineligible members being allowed to vote among other reasons.

With the ruling, KRU officials Moses Ndale (Vice Chair), Ian Mugambi (Secretary), Oscar Mango (Director) and Leslie Mwangale (Director) will vacate their positions.

KRU sent out a memo calling on Kenyans and other stakeholders to participate in the current rugby reforms.

The memo explained that the amendments were being made to help the KRU laws align with the Sports ACT 2023 and the Constitution of Kenya 2010.

Kenyans were asked to share their proposals and recommendations on or before the close of business on February 24, 2023.
