
The high court has asked the state to charge embattled FKF president Nick who is facing corruption allegations over fraudulent acquisition of public funds within seven days.
This was stated by Milimani Senior Principal Magistrate Wandia Nyamu also ruled that the term of Mwendwa's bond, which she had delivered on Monday, will remain the same.
The police were seeking to hold Mwendwa for 14 days to conduct further investigations, but Nyamu faulted them for not bringing a holding charge to the court despite arresting Mwendwa on Friday, November 12.
" I decline the application by the state and l hereby direct that the state to charge the suspect within seven days from today," Nyamu noted.
"Police arrested and detained Mwendwa irregularly which exhibited bad faith. They brought him to the court without a holding charge even after detaining him for a whole weekend," her ruling stated.
She accused the prosecution of being on a fishing expedition when they arrested Mwendwa over the weekend without having completed the probe in the matter.
The court ordered Mwendwa to remain on Sh 7million bond or a cash bail of Sh 4 million and abide by all the bond terms imposed by the court on Monday.
Mwendwa on Monday, November 15, was ordered by the court to keep off his Kandanda House office after granting him a bond of Ksh 7 million with two sureties or alternatively deposit a cash bail of Sh4 million with two contact persons.
The state through Evelyne Onuga did not comment on the figures on Monday when they sought to have Mwendwa detained for 14 days.
A condition was set for his release with him being required not to address the media or attend any football activities.
Mwendwa was also directed not to contact or talk to any of the federations employees.
The case is set to be mentioned on November 25.
