
Nick Mwendwa is yet again in handcuffs after the DPP wanted him charged with unlawful acquisition of public property.
After being arraigned before Milimani Anti-corruption court's Chief magistrate Eunice Nyutu, the suspended FKF president will remain in custody until Tuesday, when the court will rule on whether he should take plea.
Contrary to the court, Mwendwa's lawyers Eric Mutua and Mutula Kilonzo opposed the bid to have Mwendwa take a plea. His lawyers also questioned the legality of the charge.
Mwendwa was on Friday re-arrested, a day after the Director of Public Prosecutions closed a graft case against him. He was on Friday questioned at DCI headquarters on Kiambu Road over the ongoing probe into claims of corruption at FKF. Police at DCI headquarters said their probe was ongoing and added there was miscommunication that led to his release on Thursday.
He was detained at Gigiri police cells where he was Saturday picked from for further statement recording and taken back.
Mwendwa was initially arrested on November 12th and spent a weekend behind bars before being released on bail of Ksh4 million as investigations continued. The DPP had been given seven days to prefer charges against Mwendwa but chose to close its file.
"We seek to close the file as our team proceeds with probing the case at our own pace before we prefer charges against him," said the DPP on Thursday. Milimani Senior Resident Magistrate Wandia Nyamu allowed the application by the DPP and ordered the matter closed.
Mwendwa was arrested over mismanagement of public funds disbursed to the federation by the government. The state cited fictitious withdrawals amounting to Ksh 29,502,302 million and money transfers of Ksh8.5 million wired to private bank accounts including that of Mwendwa.
